پچھلے ستر برس کی تاریخ گواہ ہے کہ جب جب ملک میں کسی بھی فرد یا ادارے کے پاس کوئی اختیار پہنچا، نتیجہ اس کے غلط استعمال اور ملک کو نقصان پہنچانے کی صورت میں نکلا۔

سپریم کورٹ نے آج ایک اور نئے فیصلے میں ملکی پارلیمان کے بنیادی اختیارات پر باسٹھ اور تریسٹھ کی چھری چلا دی ہے۔ صادق اور امین والی باسٹھ تریسٹھ پچھلی کئی دہائیوں سے  سیاسی ٹولا ایک دوسرے کے خلاف چلانے کے لیے دستور سے نکالنے پر آمادہ نہیں مگر یہ ایک ایسا گڑھا ہے، جس میں ہر بار ملکی جمہوریت دفن ہو جاتی۔ پاکستانی قوم جو  ان بلا نما سیاست دانوں کو جمہوریت اور اداروں کی مضبوطی اور عوامی فلاح و بہبود کے لیے پارلیمان میں بھیجتے ہیں، یہ بار بار ہوس اقتدار میں باسٹھ تریسٹھ کا تیر اپنے فریق پر استعمال کر کے خود کو مستحکم بنانے کی کوشش کرتے ہیں یہ سوچے بنا کہ یہ وہ چھری ہے، جس کے نیچے آپ کو خود بھی آنا پڑ سکتا ہے۔ نواز شریف نے یہ چھری یوسف رضا گیلانی پر چلائی اور تالیاں بجائیں اور اب نواز شریف پر یہی چھری چلنے پر عمران خان تالیاں پیٹ رہے ہیں۔ یہ سوچے بغیر کہ اگر کبھی وہ وزیراعظم بن گئے، تو یہی باسٹھ تریسٹھ سیتاوائٹ اور جانے کس کس صورت میں انہیں ایک منٹ میں ڈھیر کر دے گی۔ نیلسن منڈیلا نے کہا تھا کہ سیاست دان اور رہنما میں فرق یہ ہوتا ہے کہ سیاست دان اگلے انتخابات کا اور رہنما اگلی نسل کا سوچتا ہے۔ سو بدقسمتی سے اس قوم کے حصے میں فقط سیاست دان ہی آئے۔

دوسری طرف عدلیہ ہے، جس کا بنیادی کام ملک میں انصاف کا بول بالا کرنا ہے، مگر وہ ستر برس سے فقط وہی کچھ کر رہی ہے، جو اسکرپٹ میں اسے لکھ کر دیا جاتا ہے۔ اس ادارے کی مضبوطی کا خواب پوری قوم نے دیکھا۔ ایک آمر جرنیل کے سامنے وکلا سمیت پوری سول سوسائٹی نکلے، مگر جوں ہی یہ ادارہ مضبوط ہوا اور اختیارات اس کے پاس پہنچے، اختیارات کا بے دریغ اور تباہ کن استعمال دیکھا جانے لگا، جیسے کسی چھوٹے بچے کی جھولی میں بہت سے کھلونے رکھ دیے جائیں اور وہ اس کی جھولی سے ادھر ادھر گرنے لگیں مگر بچے کو سمجھ نہ آئے کہ کھیلنا کس کے ساتھ ہے۔

سپریم کورٹ اور بابا رحمتے نظریہ ضرورت اور وسیع تر قومی مفاد کے تحت لکھے گئے اسکرپٹ پر پوری تاریخ میں اس قدر فیصلے کر چکے ہیں کہ اب قوم کو کسی جج سے امید رکھنے کی سوچ تک پیدا نہیں ہوتی۔

نوازشریف کو پارٹی صدارت سے نااہل قرار دینے کے ساتھ ساتھ ان کے تمام فیصلے کالعدم قرار دینا اور سینیٹ کے انتخابات پر سوالیہ نشانات کھڑے کر کے ملکی پارلیمان کو نقصان پہنچانے کی کوشش، جس بھی اسکرپٹ کا حصہ ہو، اس کا اسکرپٹ رائٹر یقینا کوئی پاکستان سے محبت کرنے والا شخص نہیں ہو سکتا۔ اسی عدالت نے جنرل مشرف کے پی سی او کے تحت حلف اٹھانے والے جسٹس ڈوگر کی تعیناتی کو کالعدم قرار دیا تھا، مگر ان کے فیصلے اور اقدامات کو کالعدم قرار نہیں دیا گیا تھا، تاہم نواز شریف کو نااہلیت کے بعد کے تمام فیصلوں بہ شمول سینیٹ کی نشستوں کی تفویض کے کالعدم قرار دینا اور ملک میں سیاسی بحران پیدا کرنا، معیشت کو ایک نیا دھچکا دینا یقینا وسیع تر قومی مفاد والے اسکرپٹ ہی کا حصہ ہو سکتا ہے۔

آج کا یہ فیصلہ ایک ایسے وقت میں سامنے آیا ہے، جب کوئٹہ میں بچے اور بچیاں میڈیکل کے امتحانات کے نامنصفانہ انعقاد پر گزشتہ کئی روز سے مظاہرے کر رہے ہیں، مگر ناحکومتی ایوانوں میں کوئی کھلبلی مچتی ہے اور نہ سپریم کورٹ جس کا بنیادی کام ملک میں انصاف اور انسانی حقوق کی دستوری ضمانت کو یقینی بنانا ہے، ٹس سے مس ہوتی ہے۔

آج کا یہ فیصلہ ایک ایسے وقت میں سامنے آیا ہے، جب سوات میں عوام گزشتہ کئی روز سے فوجی چیک پوسٹوں کے خلاف مظاہرے کر رہے ہیں اور جواب میں ان مظاہرین، لاپتا افراد کی بازیابی کے لیے نعرے اور فوجی چوکیوں پر غیرانسانی سلوک کے مطالبات کرنے والوں کی گرفتاریاں اور ایف آئی آر کے اندراج پر صورت حال کشیدہ ہے۔

کچھ روز ہوئے کوئٹہ سے ایک دوست نے مختلف آڈیو پیغامات ارسال کیے، جس میں میڈیکل کا پرچہ بنانے والا ایک صاحب کو کامیابی کی ضمانت دیتا نظر آتا ہے۔ دوسری جانب سوشل میڈیا پر وہ ویڈیوز ہر طرف دکھائی دے رہی ہیں کہ امتحان گاہ میں چند طلبہ موبائل فون استعمال کر رہے ہیں اور نگران بے خبر ہیں۔ کوئٹہ سے اس نوجوان نے سی سی ٹی وی فوٹیج کے ساتھ ساتھ تصاویر اور آڈیوز بھیجیں۔ مگر عجیب منطق ہے کہ ہمارے ان بلوچ بچوں اور بچیوں کی صاف شفاف امتحانات کے مطالبات پر سپریم کورٹ کو کیوں سنوائی کا خیال نہیں آتا؟ یا بلوچستان یا مرکزی حکومت ایسے مواقع پر کہاں غائب ہو جاتے ہیں۔  مزے کی بات ہے کہ اس تمام تر نقل کے باوجود ضلع میں ٹاپ کرنے کرنے والے فہد پٹھان سمیت متعدد پاس ہو جانے والے طلبہ بھی اس ناانصافی پر مظاہرین میں شامل ہیں، مگر پوری قوم سو رہی ہے۔ پھر یہی طلبہ جب مایوس ہو کر ریاست کے خلاف نعرے بازی شروع کر دیں یا شکوے زیادہ تلخ ہو جائیں، تو فوری بغاوت اور غداری کی لٹھ سے ان سب کو غیرملکی ایجنٹ کا لقب دے دیا جائے گا۔ میڈیا تو ظاہر ہے کوئٹہ یا بلوچستان میں کسی مظاہرے کو کیوں کوور کرے گا، اسے کیا پڑی ہے۔

سوات میں بھی لوگ اپنے حقوق کے لیے مطالبات کر رہے ہیں، تاہم وہاں بھی نہ میڈیا کا کیمرہ ان غریبوں کا دکھ دیکھنے پر آمادہ ہے، نہ ریڈیو کا مائیک سوات کے ان لوگوں کے دکھڑے سنا سکتا ہے اور نہ ہی کوئی کے پی کے کی تبدیلی کے نعرے والی حکومت یا مرکز میں دستور دستور پکارنے والے نواز لیگ کچھ دیکھنے یا سننے پر آمادہ ہے۔ ان کی اپنی چیخیں کم ہوں، تو وہ کسی دوسرے کی کوئی چیخ سنیں

ملکی عدالت جسے صادق اور امین کے سرٹیفیکٹ بانٹنے کی بجائے سب سے پہلے ملکی دستور اور قانون کی بالادستی کے لیے ان مظاہرین کی داد رسی کے لیے موجود ہونا چاہیے، وہ ان دنوں سیاسی پٹیشینز نمٹا کر، کیمروں کے ساتھ ہسپتالوں کے دورے کر کے یا عوامی اجتماعات میں خطاب کر کے یہ ثابت کرنے میں مصروف رہتے ہیں کہ وہ کتنے بہادر اور بااختیار ہیں اور ان کو مرعوب کرنے والا ابھی پیدا نہیں ہوا۔

کوئٹہ اور سوات میں جاری ان مظاہروں میں شامل تمام افراد ہمارے بھائی اور بہنیں اور اگر ان کی آواز اور دکھ سمجھنے میں ہمیں مشکل پیش آ رہی ہے، تو ہمیں بھی اپنی روش اور رویے پر غور کی ضرورت ہے۔

میڈیکل کے طلبہ اگر ان امتحانات پر مطمئن نہیں، تو نئے سرے سے امتحان لیا جانا چاہیے، تاکہ وہ غریب بچے، جن کا خواب ڈاکٹر بننے کا ہے اور جو لاکھوں روپے فی دینے کی سکت نہیں رکھتے، ان کی حق تلفی نہ ہو۔

اور دوسری طرف سوات میں اپنے حقوق کے لیے سڑکوں پر دکھائی دینے والوں کو باغی اور غدار کہنے کی بجائے، ان کی بات سنی جائے اور میڈیا ان افراد کی بات قوم تک پہنچائے۔

عدالتیں، صوبائی اور وفاقی حکومتیں ان دنوں سیاست سیاست کھیل رہی ہیں، سو ان مظلوں کی آواز ہمیں ہی بننا ہو گا۔
