ہم قدیم تاریخ پڑھتے ہیں تو ان ابتدائی ادوار کے انسانی معاشروں میں ایک شے بڑی واضح دکھائی دیتی ہے، یعنی جرم کوئی بھی سزا سزائے موت ہی ہوتی تھی۔ مگر انسانی تہذیب ارتقا پا گئی اور پھر جرم کے تعین، جرم کی وجوہات، الزامات، الزامات کی صحت، حالات و واقعات اور بہت سی دیگر چیزیں سامنے رکھ کر انصاف کے اصول اور ضابطے طے کیے گئے۔ یہ طے کیا گیا کہ جب تک کسی بھی الزام میں کسی بھی ملزم کو اپنے دفاع کا موقع فراہم نہیں کیا جاتا، جب تک عدالت میں اس جرم سے متعلق تمام تر ثبوت جمع نہیں ہوتے، جب تک یہ تسلی ہو نہیں جاتی کہ واقعی یہ ملزم ہی جرم میں ملوث تھا، اس وقت تک ملزم کو معصوم سمجھا جائے گا۔ کیوں کہ معاشرے کا مسئلہ اصل میں مجرم نہیں جرم ہوتا ہے اور کسی جرم پر کسی شخص کو سزا دینے کا مقصد بھی اصل میں اس شخص کو سزا دے کر جرم کی حوصلہ شکنی ہوتی ہے اور ایوانِ عدل میں اگر کہیں یہ احتمال بھی پیدا ہو جائے کہ ملزم جرم میں ملوث نہیں تھا، تو اسے باعزت بری کیا جاتا ہے۔ یہ باعزت بری کرنے کی اصطلاع اسی وجہ سے تراشی گئی ہے، یعنی اگر معلوم ہو کہ ملزم جرم میں ملوث نہیں تھا، تو اسے تمام تر تکریم کے ساتھ آزاد کیا جائے۔

پاکستان میں بہت سے دیگر نادرست بیانیوں کی طرح جو بات غلط العام بلکہ غلط العوام ہے وہ پولیس مقابلوں اور سٹرک پر انصاف کا معاملہ ہے۔ میرے بہت قریبی دوست جن میں سے کچھ انتہائی اعلیٰ تعلیم یافتہ بھی ہیں، وہ بھی مجھے کئی بار کچھ مخصوص واقعات میں سڑک پر انصاف کی حمایت کرتے نظر آئے۔

بہت دن پہلے کی بات ہے کراچی میں ایک مشتعل جتھے نے موبائل فون چھیننے والوں کو پکڑ لیا، پھر پہلے تو انہیں شدید تشدد کا نشانہ بنایا گیا اور پھر ان پر پیٹرول چھڑک کر سرعام آگ لگا دی۔

اس واقعے پر بھی ہمارے دوستوں کی اکثریت کا کہنا تھا کہ ’ٹھیک ہوا، ایسا ہی ہونا چاہیے تھا۔‘‘

عمومی دلیل یہی ہے کہ چوں کہ عدالتیں کم زور ہیں اور جرائم پیشہ افراد کو بری کر دیتیں ہیں، اس لیے پولیس یا فوج کو موقع پر ہی انہیں قتل کر دینا چاہیے۔ پاکستان میں پھیلی لاعلمی اور غلط فہمیوں میں سے ایک یہ بھی ہے۔

پہلی بات تو یہ ہے کہ عدالتیں عجیب کم زور ہیں، ایک طرف تو وہ وزیراعظم یا کسی سینیٹر تک کو پل میں اڑا کر رکھ دیتی ہیں اور دوسری طرف کسی جرائم پیشہ عنصر کو سزا نہیں دے سکتیں۔ اس معمے کا جواب یہ ہے کہ عدالتیں تفتیش گاہ نہیں ہوتی۔ تفتیش کرنا اور ثبوت جمع کرنا پولیس اور سکیورٹی اداروں کا کام ہے اور اگر وہ ٹھیک طرح سے تفتیش نہیں کرتے یا پکے اور ناقابل تردید ثبوت جمع نہیں کرتے اور عدالتوں کو عدم ثبوت پر کسی ملزم کو چھوڑنا پڑتا ہے، تو اس کا الزام عدالت کی کم زوری پر نہیں بلکہ سکیورٹی اداروں کی خراب کارکردگی کو دیا جانا چاہیے۔ یہ الگ بات ہے کہ بابا رحمتے اور عدلیہ کا اپنا ریکارڈ بھی کچھ زیادہ اچھا نہیں ہے اور اس دیس میں سبھی جانتے ہیں کہ ملک کی عدلیہ اور ججوں نے ملک میں انصاف کی بجائے نظریہ ضرورت کس کس طرز کے گھناؤنے کارناموں سے دیس کی تاریخ پر دھبے لگائے ہیں۔

خیر اس پر کسی اور روز گفت گو کریں گے، مگر یہ بات اہم ہے کہ کم از کم میں نے جب بھی ملک میں ماورائے آئین اقدامات یا جبری گم شدگیوں یا اس انداز کے جعلی پولیس مقابلوں یا دیگر مقامات پر فوج کے ہاتھوں ہلاک کیے جانے والوں پر بات کی، تو مجھے بہت سے دوستوں کی جانب سے ایسے غیرقانونی اقدامات کو جائز قرار دینے والے مکالمے سننے کو ملتے رہے۔

غیرقانونی کام کا سب سے بڑا مسئلہ یہی ہے کہ یہ وہ غبارہ ہے، جس میں اگر بدبودار ہوا بھری جاتی رہے، تو کسی روز یہ پھٹ جاتا ہے۔ بلوچستان میں لوگ لاپتا ہوئے، مسخ شدہ لاشیں ملیں، سننے کو ملا غدار ہیں، بھارتی ایجنٹ ہیں، ملک دشمن ہیں، فوج نے ٹھیک کیا، کراچی سمیت سندھ بھر میں لوگ غائب ہوئے، جعلی پولیس مقابلے ہوتے رہے، لوگ مرتے رہے، سننے کو ملا جرائم پیشہ لوگ ہیں، ٹارگٹ کلرز ہیں، بھارت کے ایجنٹ ہیں، اچھا ہوا غائب ہوئے، اچھا ہوا مارے گئے، خیبرپختونخوا اور قبائلی علاقوں میں یہی ماورائے آئین اور قانون کارروائیاں ہوئی، سننے کو ملا ٹھیک ہو رہا ہے، یہ سارے شدت پسند ہیں، سارے دہشت گرد ہیں۔

یہ آواز سننے کو کم کم ہی ملی کہ کوئی دہشت گرد ہے یا نہیں، کوئی ملک دشمن ہے یا نہیں، کوئی مجرم ہے یا نہیں، کوئی ایجنٹ ہے یا نہیں، کوئی معاشرتی اور سماجی تباہی کا منصوبہ ساز ہے یا نہیں، یہ فیصلہ فوج یا پولیس یا سکیورٹی اداروں نے نہیں کرنا، یہ فیصلہ صرف اور صرف عدالت کر سکتی ہے۔ اگر سکیورٹی اداروں کو یقین ہے کہ کوئی شخص مجرم ہے، تو اس کے جرم کے ثبوت جمع کرے اور عدالت سے اسے کڑی سے کڑی سزا دلوائے۔ لوگوں کو لاپتہ کرنے یا ماورائے عدالت ہلاک کرنے کا کام وہ خود کیسے کر سکتے ہیں اور ایسا اگر کیا گیا، تو یہ احتمال کیسے ختم ہو سکتا ہے کہ کوئی بے گناہ نہیں مرے گا؟

مگر ٹھیک ہو رہا ہے ٹھیک ہو رہا ہے کا شور جاری رہا۔ اور پھر آخر نقیب کی صورت میں ظلم کا یہ غبارہ پھٹ پڑا۔ وہی افراد جو کل تک ان ماورائے آئین اقدامات کو درست قرار دے رہے تھے، وہ اچانک نقیب کی موت پر رونے لگے۔ وہی افراد جو ہتھ کڑیاں پہنے ہوئے افراد کو بھی، یعنی جو پولیس کی حراست میں تھے، انہیں پولیس مقابلے کا کہہ کر قتل کر دیا گیا، مگر ہتھکڑیاں ان نعشوں کے ہاتھوں میں دیکھنے کے باوجود کسی نے ہم دردی کی نگاہ تک نہیں ڈالی، کسی نے یہ نہیں سوچا کہ اگر یہ شخص بے گناہ ہوا، تو یہ قتل کس کے سر جائے گا؟ اس کے خاندان کا کیا ہو گا؟ اس کے بیوی بچوں کا مستقل کیسا ہو گا؟ شور فقط ایک تھا، مجرموں کے ساتھ ایسا ہی ہونا چاہیے۔

نقیب کے قتل نے کم از کم ہم مردہ ضمیر لوگوں کو یہ سوچنے پر مجبور کیا ہے کہ غیرقانونی کام بند نہ ہوئے تو اس دیس کے مزید نقیب بھی مرتے رہیں گے۔ سکیورٹی اہلکار کی بندوق شہریوں اور قانون کے تحفظ کے لیے ہوتی ہے، نہ کہ غیرقانونی سرگرمیوں کے لیے۔

اب اسلام آباد میں ہزاروں افراد جمع ہیں۔ یہ تمام وہ افراد ہیں، جو اپنے اپنے علاقوں میں اپنے جسموں کے ساتھ ہمیشہ اسلحہ باندھ کر چلنے میں اپنی شان محسوس کیا کرتے ہیں، مگر دارالحکومت میں مکمل طور پر غیرمسلح اور پرامن انداز سے بیٹھے ہیں اور اس قتل پر احتجاج کر رہے ہیں۔ ایسے میں پاکستانی میڈیا کو سانپ سونگھ چکا ہے۔ ہم سب کو معلوم ہے کہ سیاستدانوں یا کسی بھی فرد کو ہر شام اپنے جملوں سے تہس نہس کر دینے والا میڈیا کب خاموش ہوتا ہے اور کس کے کہنے پر خاموش ہوتا ہے۔ پولیس ایئرپورٹ پر راؤ انوار کو باہر جانے سے تو روکتی ہے مگر اسے چھوڑ بھی دیتی ہے، راؤ انوار وٹس ایپ اور دیگر طریقوں سے ہر ہر شخص سے رابطہ کرتے ہیں، مگر سلامتی کے ادارے انہیں پکڑنے میں مکمل ناکام ہیں۔ سپریم کورٹ کے حکم تک پر عمل درآمد مشکل دکھائی دیتا ہے۔

نقیب کے قتل کے بعد ملک کے مختلف علاقوں میں احتجاج شروع ہوا اور علامتی طور پر پیدل چلتے ہوئے یہ افراد دارالحکومت میں جمع ہوگئے، تاہم ایک بڑی تعداد ہونے کے باوجود میڈیا کی توجہ اس پرامن مگر قانونی اور جمہوری احتجاج پر فقط اس طرح ہے، جیسے پریس کلب جانے والے سارے راستوں پر دلدل اگ آئی ہو اور جو صحافی اس جانب بڑھے وہ کہیں غرق ہو جائے اور کیمروں کی آنکھیں پھوٹ جائیں۔ ٹھیک یہی میڈیا چند روز قبل فیض آباد دھرنے کے وقت روزانہ چوبیس گھنٹے موجود رہا کرتا تھا اور وہاں چیف جسٹس سمیت مختلف ملکی اداروں کو سرعام گالیاں دینے والے مقررین کی کھانسی بھی بریکنگ نیوز کی صورت میں نشر ہوتی تھی۔ اس دھرنے میں ملکی وزیرقانون کے استعفے سمیت تمام مطالبات جس میں نہایت ناجائز اور غیر قانونی مطالبات بھی شامل تھے، کو فوج کی ثالثی اور ضمانت کے ساتھ منظور کر لیا گیا، مظاہرین میں پیسے تقسیم کر دیے گئے۔

اسلام آباد پریس کلب کے باہر موجود اب کے مظاہرے میں تاہم نہ میڈیا ہے، نہ حکومتی عہدیدار نہ فوجی اہلکا۔ یہاں بیٹھے لوگوں کے پانچ مطالبات ہیں اور مزے کی بات ہے کہ ان پانچوں مطالبات میں سے ایک بھی ایسا نہیں، جو غیرقانونی یا ناجائز ہو۔

مطالبات آپ سن لیجیے اور خود ہی فیصلہ بھی کر لیجیے کہ ان مطالبات کو تسلیم نہ کرنے میں کیا مصلحت ہو سکتی ہے۔

پہلا نقیب کے ماورائے عدالت قتل میں ملوث اہلکاروں کو سزا دی جائے

دوسرا کراچی اور دیگر پشتوں علاقوں میں ہونے والے تمام ماورائے عدالت ہلاکتوں کی تحقیقات کے لیے عدالتی کمیشن بنایا جائے، جس کی سربراہی چیف جسٹس کریں۔

تیسرا تمام لاپتہ افراد کو عدالت کے حوالے کیا جائے اور جو بے گناہ ہیں انہیں رہا کیا جائے۔

چوتھا فاٹا اور خصوصاﹰ وزیرستان میں کسی ناخوش گوار واقعے کے بعد عام افراد پر تشدد کا سلسلہ بند کیا جائے اور ایسے میں کرفیو نہ لگایا جائے

اور پانچواں فاٹا اور وزیرستان کے علاقے میں موجود زمینی سرنگیں صاف کی جائیں، جو اب تک درجنوں افراد کی اعضا سے محرومی کا باعث بن چکی ہیں۔

یہ سب افراد پاکستانی ہیں، پاکستانی دستور کو مانتے ہیں، غیرمسلح ہیں، پرامن ہیں اور اپنے دیس سے محبت کرتے ہیں اور اپنے حقوق کے لیے باہر نکلے ہیں۔ ان کا کوئی مطالبہ غیر دستوری نہیں۔ ان میں سے کسی نے اب تک کسی سرکاری عمارت پر پتھراؤ نہیں کیا، نہ کوئی اور پرتشدد کارروائی ہوئی۔

یہاں پاکستانی قوم سے کچھ سوالات پوچھنے کی ضرورت ہے۔ یہ مطالبات کیوں تسلیم نہیں ہو سکتے؟

یہاں موجود افراد کے ساتھ بات چیت کیوں نہیں ہو سکتی؟

یہاں مظاہرے میں موجود سینکڑوں افراد کو ٹی وی کیمرہ کیوں نہیں دکھا سکتا؟

اور کیا ہم نقیب کو ماورائے آئین ہلاک ہونے والا آخری پاکستانی بنا سکتے ہیں؟
